Özet
Amaç: Hemşireler, hasta bakımı ve klinik süreçlerdeki rolleri nedeniyle sağlık sisteminin temel unsurlarından biri olup, rolleri gereği gerçekleştirdikleri tıbbi uygulamalarla ilişkili tıbbi uygulama hatası iddialarıyla karşılaşmaktadırlar. Hemşireler, hasta bakımı ve klinik süreçlerdeki rolleri nedeniyle sağlık sisteminin temel unsurlarındandır. Görevleri kapsamında gerçekleştirdikleri tıbbi uygulamalar, tıbbi hata iddialarına konu olabilmektedir. Bu araştırma, Yargıtay’da karara bağlanan hemşire tıbbi uygulama hatası iddialarının adli tıbbi açıdan retrospektif olarak değerlendirilmesi amacıyla yapılmıştır. Gereç ve Yöntemler: T.C. Yargıtay Başkanlığı resmi internet sitesi üzerinden “Hemşire” anahtar kelimesi ile ulaştığımız 2003-2022 yılları arasında hemşire tıbbi uygulama hatası iddiasıyla değerlendirilen 39 davanın Yargıtay temyiz kararları retrospektif olarak incelenmiştir. Bulgular: Yapılan incelemede hemşire tıbbi uygulama hatası iddialarının %82,1’inin (n=32) hatalı enjeksiyon kaynaklı olduğu ve %68,8’inde (n=22) uygulanan ilacın analjezikler olduğu tespit edildi. Gerçekleşen olayların çoğunlukla bir kamu hastanesinde ve acil serviste gerçekleştiği, %84,8’inde (n=28) kalıcı hasar geliştiği ve tamamının sinir hasarı olduğu görüldü. Açılan davalarda hemşirelerin %78,6’sının (n=22) taksirle yaralama ile yargılandığı, dava dosyalarının %79,4’ünde (n=31) bilirkişi görüşü alındığı ve bu görüşlerin çoğunlukla Adli Tıp Kurumundan talep edildiği belirlendi. Dava dosyalarının %60’ında (n=9) bilirkişi raporunun yetersiz bulunması sebebiyle yerel mahkeme kararının bozulduğu tespit edildi. Sonuç: Hemşirelerin klinik becerilerinin geliştirilmesi, mesleki sorumluluk bilincinin artırılması ve iş yükünün dengelenmesi, hasta güvenliği ve hemşirelik mesleğinin kalitesini iyileştirebilir. Bunun yanı sıra, sağlık kurumlarında denetim mekanizmalarının iyileştirilmesi, bilirkişi süreçlerinin uzmanlıkla yürütülmesi ve eğitim programlarının güçlendirilmesi önem arz etmektedir.
Objective: Nurses are one of the key elements of the healthcare system due to their roles in patient care and clinical processes, and they face medical malpractice claims related to the medical practices they perform as part of their roles. Nurses are essential elements of the healthcare system due to their roles in patient care and clinical processes. The medical practices they perform within the scope of their duties may be subject to medical error claims. This study aimed to retrospectively evaluate nurse medical malpractice claims adjudicated by the Court of Cassation from a forensic medical perspective. Material and Methods: We retrospectively analyzed the appellate decisions of the Court of Cassation in 39 cases evaluated with the allegation of nurse medical malpractice between 2003 and 2022, which we accessed with the keyword “Nurse” on the official website of the Presidency of the Supreme Court of Appeals of the Republic of Türkiye. Results: It was determined that 82.1% (n=32) of the nurse medical malpractice claims were due to faulty injections and the medication administered in 68.8% (n=22) of the cases was analgesics. It was seen that the incidents occurred mostly in a public hospital and emergency room, 84.8% (n=28) of the incidents resulted in permanent damage and all of them involved nerve damage. It was determined that 78.6% (n=22) of the nurses were prosecuted for negligent injury, 79.4% (n=31) of the case files received expert opinions and these opinions were mostly requested from the Forensic Medicine Institution. In 60% of the case files, the local court decision was reversed due to the inadequacy of the expert report. Conclusion: Improving nurses’ clinical skills, increasing their awareness of professional responsibility and balancing their workload can improve patient safety and the quality of the nursing profession. In addition, it is important to improve supervision mechanisms in health institutions, conduct expert witness processes with expertise and strengthen training programs.
