dc.description.abstractİslam ceza hukukunun bir kısım suçlar için bedene yönelik cezalar öngörmesi, cezaların infazı konusunu cezalandırma sürecinin en önemli unsuru haline getirmiştir. Günümüzde İslam ceza hukuku, mer’î olmaması nedeniyle teoride kalan bir hukuk sistemidir. Bu durum toplum nezdinde İslam ceza hukuku hakkında yanlış kanaatlerin oluşmasına sebep olmuş, infazın belli kural, kaide ve ilkelerinin olduğu göz ardı edilmiştir. Bunun böyle olmasında İslam ceza hukukunu uyguladıklarını iddia edip tam manasıyla uygulamayan ülkelerin rolü de inkâr edilemez. Bu çalışmayla İslam ceza hukukunda cezaların infazının gelişi güzel yapılmadığını ve infazın, çerçevesi ayet ve hadislerle çizilmiş, belli başlı ilkelerinin olduğunu ortaya koymayı amaçladık. Temel fıkıh metinlerinden hareketle cezaların infazında uyulması gereken dört temel ilke olduğunu tespit ettik. Bu ilkeler; infaz anında mahkûmun hak ettiği cezanın dışında başka bir cezayla cezalandırılmasının önüne geçen kanunilik ilkesi, infazın gizli saklı bir şekilde sadece cellatla mahkûmun baş başa kaldığı bir ortamda yerine getirilmesini engelleyen alenilik ilkesi, infaz anında mahkûmun suçlu da olsa bir insan olduğunun göz ardı edilmediği insanîlik ilkesi ve kendiliğinden hak almayı engelleyip toplumun kaosa sürüklenmesini engelleyen merkezîlik ilkesidir
dc.description.abstractIslamic criminal law made the execution of sentences the most essential element of the punishment process by proposing corporal punishments for some crimes. Today, Islamic Criminal Law is just a theoretical law system because it is not in force. This situation created wrong opinions about Islamic criminal law; and certain rules, norms, and principles of the executions have been ignored. The main cause of these opinions is the countries which claim that they apply Islamic criminal law but in fact, they do not. In this study, we concluded that it is not true, and aimed to present that the execution in Islam has certain principles which are framed with verses and hadiths. By investigating the basic fiqh texts, we have determined that there are four basic principles that should be followed on the execution of the punishments. These principles are (a) legality principle, which prevents from punishing with another punishment other than with which the convict deserves; (b) publicity principle, which prevents from executing the punishment on another place other than where the convict would be with the executioner; (c) humanity principle, which the convict is considered as a human; and (d) centrality principle, which prevents from creating chaos in the society by preventing from having a right by itself
